Because the men have typically been in custody for 24 hours or more, they are dehydrated and often unable to produce a urine sample that would be the most effective gauge of whether they have such a disease. So instead, a medic inserts a Q-tip in the penis for a sample that's analyzed.

Men who try to avoid the procedure are threatened by jail guards with a beating, according to Tom Morrissey, an attorney representing such inmates in a class-action lawsuit against the Cook county.

County officials have argued that the testing serves a public good by targeting a population at high risk for sexually transmitted diseases.

The day after Morrissey appeared in federal court this week, trying to convince a judge he needs greater access to the area of the jail where inmates are tested, Dr. Robert Simon, the new county health chief, announced that he will drop the program to help balance the county budget.
