Thank you for writing to me regarding efforts to limit the
sale of pseudoephedrine, a key ingredient in methamphetamine
(meth) production. I appreciate your thoughts on this important
topic and welcome the opportunity to respond.
The production and abuse of methamphetamine, a highly
addictive and relatively cheap drug, is a nationwide problem that
has reached epidemic levels. In California especially, meth
production and use continues to infest neighborhoods and
communities. California has been identified as a "source country"
of meth, much like Columbia is for cocaine, as more than 80
percent of the nation's meth originates in California. In 2002
alone, over 1,700 meth labs were seized and shut down in
California.
With the production and use of methamphetamine at an all
time high, it is important that we do everything possible to fight
the scourge of this dangerous and often deadly drug. That is why
Senator Jim Talent (R-Mo.) and myself have introduced the
"Combat Meth Act" (S.103), designed to curb methamphetamine
production by moving pseudoephedrine, the primary ingredient to
make meth, behind the pharmacy counter.
The key ingredient of meth is ephedrine, a tightly
controlled substance. Because of the difficulty in obtaining
ephedrine legally, drug dealers have turned to a less-regulated
substitute, pseudoephedrine, found in many over-the-counter
medicines, which can be processed to produce ephedrine. S. 103
would classify pseudoephedrine as a Schedule V drug, meaning
products containing pseudoephedrine must be kept behind a
pharmacy counter and sold only by a pharmacist or pharmacy
technician. Under the bill, buyers can purchase no more than 9
grams, or roughly 300 pills, over a 30 day period. They would be
required to present proof of identification and sign for the medicine
upon purchase. Also, S. 103 provides funding for
Methamphetamine Precursor Monitoring Grants, allowing states to
create programs to track purchases of pseudoephedrine. An
effective monitoring program will allow law enforcement officials
to track suspicious buying behavior of ingredients for meth
production, and theus deter or interdict meth production.

* Provide critical resources to local law enforcement and
prosecutors- Authorizes an additional $15,000,000 under
the COPS program to train state and local law enforcement
to investigate and lock-up methamphetamine offenders and
expands the methamphetamine "hot spots" program to
include personnel and equipment for enforcement,
prosecution and environmental clean-up.
* Expand the ability of local prosecutors to bring
methamphetamine distributors to justice - Authorizes
$5,000,000 to hire additional federal prosecutors and train
local prosecutors in state and federal meth laws and cross-
designate them as Special Assistant U.S. Attorneys,
allowing them to bring legal action against meth cooks and
traffickers in federal courts under tougher guidelines.
* Provide services for children affected by the spread of
meth - Authorizes $5,000,000 in grant funding for Drug
Endangered Children rapid response teams to promote
collaboration among federal, state, and local agencies to
assist and educate children that have been affected by the
production of methamphetamine.
* Enhance treatment options - Authorizes the creation of a
Methamphetamine Research, Training and Technical
Assistance Center which will research effective treatments
for meth abuse and disseminate information and technical
assistance to states and private entities on how to improve
current treatment methods.
