birdwatcherThe Village Board of far northern Chicago suburb of Mundelein voted Tuesday night to approve an ordinance that criminalizes cutting classes. Students caught hanging around the village when they should be in class can now be arrested and fined between $25 and $750. Their parents can be fined, too.
The police chief in Mundelein said there is a clear corrеlation (о, коллега) between skipping class, crime, and gang activity.

RE: School Curfew Ordinance
EXPLANATION:
In light of loopholes in the truancy law, increased truancy, and the negative impact it is having on the community, we feel it is in the best interest of the Village to impose a daytime curfew ordinance for persons under the age of 18. As more schools impose out-of-school suspensions, more children are unmonitored and out in the community during the day, potentially endangering themselves or others.
MOTION REQUESTED: Motion to adopt ordinance.
AN ORDINANCE ESTABLISHING A SCHOOL CURFEW IN THE VILLAGE OF MUNDELEIN, ILLINOIS
WHEREAS, the Village of Mundelein has determined that regular attendance at school is important to the educational process; and
WHEREAS, the Village of Mundelein believes it is important to hold parents or other legal guardians of students responsible for insuring regular attendance at school.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MUNDELEIN, LAKE COUNTY, ILLINOIS, as follows:
SECTION I:
A. Prohibited. It shall be unlawful for any person under the age of eighteen (18) years, who is enrolled in any public, private or parochial school to absent himself or herself from attendance at school without parental permission. Any person who shall so absent himself or herself shall be guilty of the offense of truancy. No student shall be considered truant if the absence is due to an emergency or unforeseen illness or other causes beyond the control of the person so absenting himself or herself from school if parental permission for such absence is submitted in writing to the proper school authorities within 24 hours after such absence.
B. It shall be unlawful for any person under the age of eighteen (18) years, who is enrolled in any public, private or parochial school to be present at or upon any street, park or other public place, or in any building open to the public, other than school during any hours when school is in session during the regular school term, unless he or she is:
1. Traveling to or from school by the most direct route; or
2. Engaged in school related activities with written approval of school authorities or as otherwise authorized by written school policy; or
3. Engaged in personal business, including without limitation employment, medical care and religious activities, with prior written consent from a parent, legal guardian or other adult having lawful custody or supervision of such person to school authorities; or
4. Accompanied and supervised by a parent, legal guardian or other adult having lawful custody or supervision of such person.
C. It is hereby made unlawful for any parent, guardian or other person having the legal care and custody of any person under eighteen (18) years, to allow or permit any such child, ward or other person under such age enrolled in a public, private or parochial school, to absent himself from attendance at school without parental permission.
D. Investigatory detention. Any police officer may stop and detain a person whom the police officer reasonably suspects to be violating this section for purpose of verifying the detained person's identity, age, school enrollment and authority to be absent from school. The police officer shall immediately inform the detained person of the reason for the detention and that he or she will be released upon verification of authorization to be absent from school. If the detained person refuses to provide the police officer with the necessary information, or if authorization to be absent from school cannot be verified within fifteen (15) minutes of the detention, the detained person shall, if practicable, be taken to school authorities or a parent or legal guardian or other adult having lawful custody or supervision of such person.
F. Penalties. Any person violating any of the provisions of this section shall be fined not less than $25.00 nor more than $750.00 for each offense, and every day on which a violation occurs or continues shall be considered a separate and distinct offense.
SECTION II: This ordinance and each of its terms shall be the effective legislation of a home rule municipality without regard to whether such ordinance should (a) contain terms contrary to provisions of current or subsequent non-preemptive State law; (b) legislate a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities that to the extent that the terms of this Ordinance should be inconsistent with non-preemptive State law, that this ordinance shall supersede State law in that regard within its jurisdiction.
SECTION III: Conflict. All Ordinances or parts of Ordinances in conflict with this Ordinance are expressly repealed.
SECTION IV: Severability. If any provision of this ordinance is held invalid, such provision shall be deemed to be excised from this ordinance and the invalidity thereof shall not affect any of the other provisions of this ordinance. If the application of any provision of this Act to any person or circumstance is held invalid it shall not affect the application of such provision to such persons or circumstances other than those as to which it is held invalid.
SECTION V: This Ordinance shall be in full force and effect from and after its passage, approval and publication, as required by law.
SECTION VI: This Ordinance shall be published in pamphlet form and available in the Village Clerk's Office.
PASSED this______day of October, 2006, by the Mayor and Board of
Trustees of the Village of Mundelein, Illinois, on a roll call vote as follows:

Date: 2006-10-12 11:22 am (UTC)Соответственно, решение поселкового совета могут признать неконституционным или нарушающим федеральный закон. Для окончательной безнадежности, существует еще Конституция Иллиноя.
В результате этого нагромождения ерунды приходим к ситуации, когда люди в затерянной в прериях деревушки никакими силами не могут огородиться забором и построить школу по своему вкусу без вмешательства Ивана Ивановича, заседающего в Вашингтоне в кабинете 415. Это, очевидно, очень плохо.
