WEST BOYLSTON, Mass. -- A high school history teacher in West Boylston has been placed on administrative leave after being charged with distributing material harmful to minors over the Internet.

Restriction of access by minors to materials commercially distributed by means of World Wide Web that are harmful to minors":


``(6) Material that is harmful to minors.--The term
`material that is harmful to minors' means any communication,
picture, image, graphic image file, article, recording,
writing, or other matter of any kind that is obscene or
that--

``(A) the average person, applying contemporary community
standards, would find, taking the material as a whole and
with respect to minors, is designed to appeal to, or is
designed to pander to, the prurient interest;

``(B) depicts, describes, or represents, in a manner
patently offensive with respect to minors, an actual or
simulated sexual act or sexual contact, an actual or
simulated normal or perverted sexual act, or a lewd
exhibition of the genitals or post-pubescent female breast;
and

``(C) taken as a whole, lacks serious literary, artistic,
political, or scientific value for minors.

``(7) Minor.--The term `minor' means any person under 17
years of age.''.

Scott A. Simoncini, a high school history teacher at West Boylston Middle-High School for the past five years, pleaded not guilty yesterday in Leominster District Court to five counts of disseminating obscene material to a minor and two counts of attempting to commit a crime (enticement of a child under 16).

Mr. Simoncini, 35, of Worcester, formerly of Holden, allegedly transmitted nude photographs of himself while conversing over the Internet in December 2006 and in January 2008 with someone who identified herself as a 14-year-old girl.
