A person close to the case said Malvo is expected to plead guilty to the Maryland charges against him and testify for prosecutors. The person close to the case requested anonymity because the deal was not officially set. But just what Malvo will say remains a mystery.

Напоминаю, речь идет о сделке со следствием человека, уже приговоренного к маскимально возможному для него наказанию, о том, чтобы дать показания против сообщника, уже приговоренного к смертной казни.

А трагедия общин состоит в том, что с этими следствиями и судами теперь абсолютно ничего нельзя поделать.

Well, with Malvo there is probably an issue. He is serving Virginia life,
but can he get paroled ? If he is convicted in Maryland,
and get paroled in Viriginia, Maryland conviction will matter.

Мне это тоже пришло в голову, но увы: On December 23, 2003, a jury sentenced Malvo to life in prison without the possibility of parole (http://en.wikipedia.org/wiki/Lee_Malvo#Criminal_prosecutions) for the murder of Franklin. On March 10, 2004, a judge agreed with the verdict and formally sentenced him to life in prison without parole.
