Полтора года продолжался поиск решения Проблемы крыши [1]. Лучшие кодоминиумные юристы Иллиноя установили: крыша, толщиной 12 дюймов, расположена между потолком нижних соседей и полом моего балкона. Соседи обязаны чинить свой потолок, я обязан класть плитку у себя на полу, а крышу должна чинить вся ассоциация сообща. Прилагаю кусочек доказательства (автор - Марк Перлстайн).Enclosed is a Memorandum from Patricia O'Connor to me, explaining that the Plat of Survey shows that the rooftop terraces in the four elevations are, in fact, composed of two separate areas; the space approximately twelve inches (12") deep between the ceiling of the Unit below and the floor level of the terrace, and the terrace floor surface. This twelve inch (12") space is not part of the Unit, nor is it classified as a Limited Common Element. Rather, this area is a Common Element which is the responsibility of the Association to maintain and repair. Thus, as Ms. O'Connor explains, the rooftop terrace sits atop a Common Element roof. The repair of this roof portion is the Association's responsibility. The Owner is responsible for payment of the flooring surface for their particular terrace area.
