The 28-year-old social studies teacher and boys freshman boys' basketball coach allegedly had a relationship with a 17-year-old female student, Amy Jacobson reported Thursday. (Тут имеются в виду не два человека, а один и тот же: физрук, он же преподаватель основ советского государства и права).

The junior girl told one of her friends, and word of the relationship got around.

Since January there have been five sexual encounters.

"It's a trauma to a young victim. She's a 17-year-old. This was a person of authority. So, it's going to take a lot of time and a lot of counseling to get over this," Krecker said.

А я думал, 17-year-old - это взрослая женщина.

И что такой неподходящий термин был выбран не по ошибке или недосмотру, а умышленно.

Sorry for English, but it is faster. Of course the worst possible term was chosen. In a state near me, driving 15 miles above speed limit is a "reckless driving", which is a criminal offense. That's how criminal laws are written.

BTW, what is msot idiotic (here and more so in drug laws) is mandatory sentence.

It's not the same. What's reckless - 15 or 25 over speed limit, who's to say, it's all relative.

On the other hand, consensual kisses and caresses are not battery. There is no relativity here, it's just a false definition, and what's worse, purposely so.

Спасибо, этого аспекта я вообще не осознавал.

Well, going above speed limit is speeding. Reckless can be abrupt changing lanes or driving 100 in dense fog. Speed alone is not reckless.

consensual kisses and caresses

What about consensual S&M ? Would it fall under caresses ?

I'll disagree on that. I like driving fast, but I do realize that speed kills.
When you go fast enough you don't have time to react, others don't have time to react, it is at least as reckless as suddenly changing lanes and the consequences can be much worse. Besides, you can't be driving faster than others without changing lanes.

What about consensual S&M ? Would it fall under caresses ?

S&M creates a separate problem which has nothing to do with age difference. Simulated rape is a common part of S&M, so how do you separate simulated from real?
I could expand on that, but I don't think it is necessary in this context.
When there are just caresses and kisses, you can't talk about battery with a straight face.

You just demonstarted that conditions matter - an empty highway
and a crowded one, difference in reaction times, so speed alone is not reckless.

Besides, "speed kills" is an insurance companies propaganda. Check which percent of accidents happens at 65 mph roads.
