Кстати, мне очень понравилось определение "in a position of trust". Друг - это in the position of trust? I certainly think so.
То есть 17-летняя переспит с 17-летним другом, его осудят? Кстати, может быть, наоборот, её?

Well, the laws are often imbalanced - the boy thak kills adult will be punished much more lightly than adult that kills a boy. What you are arguing is different age limits for boys and girls. Sure, makes sense.
BTW, some states have close in age exception, so I am not convinced that abstinence is a driver for these laws. But I don't claim knowledge.

This is not what I am talking about. I am talking about a very specific assertion: he understands what he is doing when he is having sex.
